ACT:Court upholds injunction on asylum seekers

The government was prevented from sending 16 asylum seekers to Kuala Lumpur yesterday,
after High Court judge KENNETH HAYNE issued a temporary injunction late on Sunday.

Today, Justice HAYNE extended the injunction until the full bench can consider the
lawfulness of the government's policy.

He says it's likely the full court could hear the matter in a special sitting in the
week beginning August 22.

PAC: Johnny heads for NZ amid Farnham furore

By Peter Williams, New Zealand Correspondent

AUCKLAND, Feb 18 AAP - When Australian Prime Minister John Howard flies to New Zealand
this weekend for regular trans-Tasman talks, the sounds of The Voice may be ringing in
his ears.

In the loud debate over whether John Farnham should perform at this year's Anzac service
at Gallipoli on April 25, Howard has so far maintained a solemn silence - just the way
New Zealand Prime Minister Helen Clark would like the annual commemoration to be.

A classical music fan herself, Clark says even though she'd never heard of Farnham
she doesn't want him or his kind belting out a few numbers before dawn at Anzac Cove.

It's New Zealand's turn to call the shots about how to mark this year's 90th anniversary
of the Anzac campaign and Clark won't tolerate having a "concert in a cemetery".

Unlike Howard, Clark doesn't have to worry about offending fans of the man known as The Voice.

In fact Farnham has such a low profile in New Zealand that radio stations have been
playing some of his tracks to familiarise audiences with his material.

Both sides maintain the Anzac service hasn't been finalised and Howard and Clark may
find themselves spending more time on the anniversary plans than previously thought.

A visit to Wellington this week by Peter Costello hasn't exactly smoothed the way for
Howard. The treasurer's apparent support of a single regulator of Australian and New Zealand
banks has aroused the usual fears of Aussie domination.

New Zealand Finance Minister Michael Cullen today strongly denied local reports that
Australia is pressuring its neighbour to accept the move.

Nationalist firebrand Winston Peters weighed in, accusing the Labour government of
helping Australia gradually colonise New Zealand by stealth.

"One day we could all wake up speaking 'strine' and our sports teams will be wearing
canary yellow instead of black. If that happens, much of it will be this government's
fault," the New Zealand First leader said today.

Extending and deepening economic relations towards achieving a single market are on
the Howard-Clark agenda, as are counter-terrorism, stability in the Pacific region, and
the implications of the tsunami disaster for Asia.

Howard arrives tomorrow night in Auckland and will spend much of Sunday with Clark
before attending a reception with business and community leaders.

On Monday, he flies to Wellington to visit parliament and meet with Clark's cabinet.

He'll conclude his visit when he lays a wreath at the capital's war memorial. It's
a good bet no Farnham music will be played.

NSW:More rail hitches to come, govt says

NSW:More rail hitches to come, govt says

SYDNEY, April 12 AAP - Rail commuters should expect more debacles like the one that
crippled Sydney's train lines and left 100,000 people stranded during the morning peak,
says NSW Transport Minister Gladys Berejiklian .

"I know people were let down today," she told reporters in Sydney on Tuesday.

"I know they've been let down before and unfortunately there maybe other occasions
when they're let down."

Less than two weeks into her new job, Ms Berejiklian and CityRail senior management
had to face the media following a computer failure that affected signalling equipment
at Sydenham, in the city's inner west.

About 7.40am (AEST) the computer hardware that allows the signalling system to switch
between its primary and backup systems failed, resulting in red signals controlled by
Sydenham station.

The Bankstown, inner west, southern, airport, East Hills, Eastern Suburbs and Illawarra
lines saw delays of at least two hours.

Ms Berejiklian blamed the former Labor government, accusing it of under-investing in
CityRail projects for the past 10 years.

She also said commuters should expect more failures similar to the Sydenham shutdown
before things improve.

"We've always known that turning around the system will take more than a week.

"It will take more than a month. It will take more than a year."

CityRail chief operating officer, Andy Byford joined Ms Berejiklian at the press conference
and said technicians were able to reboot the system and restored services by 9am (AEST).

"My job is to run a punctual railway and we didn't manage to do that this morning,"

Mr Byford told journalists.

He said technicians had not yet determined exactly what caused the problem and he couldn't
elaborate on why the switching mechanism caused both systems to fail.

By early afternoon on Tuesday, commuters at Town Hall station were being told not to
take trains to destinations affected by the failure due to extended delays.

Mr Byford expects the system to return to normal by 2pm but would not agree to providing
free passage on the City Rail network for the afternoon peak.

"My priority at the moment is to focus on making my train service run on the right
time tonight," Mr Byford said.

NSW:Inquiry in doubt after parly prorogued

NSW:Inquiry in doubt after parly prorogued

By Adam Bennett

SYDNEY, Dec 22 AAP - Critics have vowed to push ahead with a parliamentary inquiry
into NSW's $5.3 billion electricity sale despite government attempts to kill it off by
shutting down parliament.

The future of the inquiry was thrown into doubt on Wednesday morning when Premier Kristina
Keneally announced Governor Marie Bashir had prorogued parliament.

The shock move, which came two months earlier than expected, means the parliamentary
session has now officially been brought to a close.

Opposition Leader Barry O'Farrell immediately accused the government of trying to derail
the upper house inquiry ahead of the state election in March.

But Christian Democratic Party MP Fred Nile and the Greens later obtained advice from
the clerk of the upper house that the inquiry could go ahead.

Mr Nile, the chair of the upper house committee that will investigate the controversial
sell-off, announced hearings would begin the week of January 17.

He said the parliamentary committee would meet as planned at 2pm (AEDT) on Thursday,
to set the terms of reference.

"I think it was a bit like a poker game, a bluff, they thought by doing that, everybody
said `that's it, no committee inquiry'," he said.

"But I've made inquiries and advice from the clerks. There is nothing to stop the committee
meeting."

While Labor MPs Greg Donnelly, Luke Foley and Kayee Griffin will attend Thursday's
meeting, the government pointed to Crown Solicitor's advice that committees can't sit
once parliament has been prorogued.

A spokeswoman for Ms Keneally would not say if the government will challenge the legality
of the inquiry, which could see the dispute dragged through the courts.

Mr Nile said Treasurer Eric Roozendaal, who is in the US on government business, had
called him on Tuesday to express his concerns the inquiry might jeopardise the second
tranche of the sale.

The so-called gentrader rights of Macquarie Generation and Delta's NSW central coast
power stations will be completed early in the new year.

The first tranche of the sale was controversially announced by media release just before
midnight on Tuesday last week.

The resignation of eight board members from Eraring Energy and Delta Electricity, in
a last-minute protest over the deal, further soured the sale.

Under the power sell-off TRUenergy has paid $2.035 billion for retailer EnergyAustralia
and the right to trade the output generated by Delta West.

Origin Energy paid $3.25 billion for smaller retailers Integral Energy and Country
Energy, together with the trading rights for Eraring Energy.

The opposition, Greens and business lobby have criticised the partial privatisation,
saying the government hasn't realised the full value of the assets, and that the sale
would lead to less competition.

Both Ms Keneally and Mr Roozendaal have defended the sell-off, saying the assets sold
for "well above" their retention value.

They have also dismissed opposition calls for a judicial inquiry into the sale, but
said they would welcome the scrutiny of the state's auditor-general.

FED:Hockey rules out false promises

SYDNEY, Aug 14 AAP - The coalition is not going to make promises in the last week of
the federal election campaign that it cannot deliver, opposition Treasury spokesman Joe
Hockey says.

A Nielsen poll in Fairfax newspapers on Saturday put Prime Minister Julia Gillard's
Labor party ahead by 53 per cent to the coalition's 47 per cent on a two-party preferred
basis.

This was a marked turnaround from the coalition's 51 per cent to 49 per cent a week earlier.

A separate Newspoll in The Australian newspaper on Saturday showed Labor would lose
key seats in Queensland and NSW but there was a big swing to the government in Victoria.

Mr Hockey said on Saturday that too much focus has been on the campaign process and
not enough on policy.

"I'm sure there will be new (policy) commitments," Mr Hockey told reporters in Sydney.

"But if someone thinks there is going to be a multi-billion dollar, big, enormous promise
from the coalition on the eve of the election that is going to be a game changer, I'm
sorry we are not going to make promises we cannot deliver.

"I will not allow us to do that.

"We are going to make promises that we can pay for."

Queensland's Liberal National Party has launched legal action to overturn the election
result in the Brisbane seat of Chatsworth .. claiming vote fraud.

The application on behalf of failed LNP candidate ANDREA CALTABIANO has been filed
in the Court of Disputed Returns.

Labor's STEVE KILBURN .. who won the seat by 74 votes .. has a week to respond to the claim.

The LNP alleges people voted more than once and used the names of people who weren't
entitled to vote .. to cast a ballot.

The party also claims in court documents some people who were entitled to vote were
denied a ballot .. and it questions the integrity of the vote count which was moved from
a building in the electorate to the electoral commission's headquarters for security reasons.

NSW: Giant whale carved into Bondi Beach

SYDNEY, Dec 9 AAP - Greenpeace members protesting the arrest of two activists in Japan
have carved a giant whale into Sydney's iconic Bondi Beach.

About 30 protesters sculpted the 17-metre fin whale into the sand on Tuesday, calling
for whaling to be put on trial rather than the activists.

The whale was blessed by a group of Buddhist monks, while two protesters stood in a
cage wearing masks with pictures of Junichi Sato and Toru Suzukis, the so-called Tokyo
Two.

The Greenpeace activists were arrested in June for allegedly stealing two boxes of
whale meat and face up to 10 years in prison.

The environmental group said the two men had only tried to gather evidence in an attempt
to expose a corruption scandal in the whaling industry.

Greenpeace whales campaigner Reece Turner said protesters were gathering signatures
on a petition for the pair, and the event was part of a series of protests in 12 countries.

He said the sculpture would remain in the sand until Thursday.

It was two metres high and roughly the same size as a juvenile fin whale, a threatened
species hunted by Japan's fleet in the southern ocean, he said.

"We want Japan to know we're going to be keeping up the pressure and we're committed
to the campaign," he said.

Qld: Apology first step to improving indigenous life: Bligh

BRISBANE, Feb 12 AAP - The formal apology to the stolen generations is the first step
to improving problems in indigenous communities such as alcohol abuse, Queensland Premier
Anna Bligh says.

Prime Minister Kevin Rudd will say sorry to Aboriginal people in Canberra tomorrow
for past policies of forcibly removing indigenous children from their families.

Ms Bligh will meet with 19 indigenous mayors in Cairns on Friday to discuss changes
to alcohol management plans.

She will offer a share in federal government funding for alcohol rehabilitation services
to communities who agree to trial prohibition.

Ms Bligh said tomorrow's historic apology was an important step towards serious indigenous
policy reform.

"We must do better," Ms Bligh told state parliament today.

"Alcohol abuse is at the core of much of the dysfunction, poverty, disease and violence
which continues to blight our indigenous communities."

The government has already moved the Indigenous Government Coordination Office into
the Premier's Department to fast-track changes to the alcohol management plans.

Ms Bligh said this reflected the government's sense of "urgency and priority".

"Little children should be safe at home, they should be cared for by parents sober
enough to ensure that they are protected, they should be well fed, and they should be
getting enough sleep and going to school," she said.

"Until the vast majority of adults in our indigenous communities are sober this will
simply never be a reality.

"Friday's meeting is about changing that reality."

NSW: Man charged with murdering man found shot in the head

SYDNEY, Aug 25 AAP - Police have charged a second man over an execution-style shooting
in Sydney's south-west last year.

The body of 47-year-old Christian Minotte was found in the backyard of his home in
Oliphant Street at Mount Pritchard, in April last year.

A post-mortem examination showed Mr Minotte had been shot in the back of the head.

Police arrested a 23-year-old man who fled after they stopped his vehicle at the intersection
of the Horsley Drive and Hassall Street in Smithfield just after midnight yesterday.

He was taken to Cabramatta police station, where he was charged with murder.

The man remains in police custody and will appear in court on a date to be determined.

This follows the arrest of a 24-year-old man in Lithgow who was charged with murder
on July 18 last year.

Fed: Sheik should consider leaving Australia: PM

MELBOURNE, April 10 AAP - Prime Minister John Howard has backed calls for controversial
mufti Sheik Taj Aldin Alhilali to consider leaving Australia, saying he is an embarrassment
to most Australian Muslims.

Both the government and opposition have called for the sheik to be sacked and to leave
the country after he called on Australian Muslims to back Iran's hardline regime.

The Australian Federation of Islamic Councils (AFIC) suspended the sheik's salary last
year after he likened scantily-clad women to uncovered meat.

Last week, the council said his future would be decided by the National Council of Imams by June.

Speaking on the Nine Network tonight, Mr Howard backed statements from Immigration
Minister Kevin Andrews yesterday that the sheik should think about leaving Australia.

"He certainly, in the words of Kevin Andrews, should make up his mind whether he wants
to be an active, articulate, free-speaking member of the Australian community or, if he
doesn't, he ought to go somewhere else," Mr Howard said.

"I think he is an embarrassment to his own religious flock.

"I feel sorry for the 99 per cent of Australian Muslims who are obviously embarrassed
by this man."
